Please read these terms of service and all referenced materials carefully before using Polygon X.

By accessing and using Polygon X in any way, you agree to be bound by this agreement, including the warranty disclaimers, limitations of liability, and termination provisions below. If you do not agree to the terms, please leave the application immediately and do not use Polygon X.

Definitions

“Agreement” means these Terms of Use and all materials referred or linked to in these Terms of Use.

“Application means the Polygon X software, including a database of configuration files (built-in material profiles and presets), accompanying materials, and updates.

“PICASO 3D” means PICASO 3D, LLC and any entity which directly or indirectly controls, is controlled by, or is under common control with PICASO 3D, LLC.

“Device” means a 3D printer designed by PICASO 3D and built on the X software platform, which could be used to execute print files from Polygon X, or for which they could be created.

"User(s)" means Customer's employees, representatives, consultants, contractors or agents who are authorized to use the Polygon X for the benefit of Customer and who have been supplied user identifications and passwords by Customer.

“Update(s)” means any modifications, fixion or improvement of Application.

“Service(s)” means any additional software components designed by PICASO 3D which could improve or increase the Application functionality.

Installing and activation

The PICASO 3D offers to Users access to a wide range of Software services, including converting digital three-dimensional objects into executable code for 3D printing on Devices, monitoring the status of Devices connected to the local network, communication tools, personalization, creating and storing various types of information and materials.
Users are granted a non-exclusive right to use the Application (non-exclusive license) within the functionality of the Application and Devices, provided that Users complies with all technical requirements, as well as all restrictions and conditions of use of the Application specified in this Terms of Use.
The right to use the Application is granted free of charge without limitation of functionality (subject to activation of the program instance).
The Application is written on a starter USB-drive and is supplied as part of the Device. Users can also download the current version of the Program from the official website of the PICASO 3D.
After installing the Application, the User has access to limited functionality. In order to use all the features of the Application including preparing tasks for printing on Devices, Users will need to activate the Application.
Users can go through the activation procedure from any device on the official website of the PICASO 3D. Users will receive an email with an username, password, and licence code.
Users can also activate the Application using its interface. In this case, users will receive an email with an username and password. The Application will be activated without using the licence code.

Conditions

The user uses the Application under a simple (non-exclusive) license.

The term of the license: unlimited. Territory of action: worldwide.

PICASO 3D recommend to use the Application only in compliance with its intended purpose. The Application is intended to work on devices by PICASO 3D only.

Regardless of the method of purchasing the Application (as part of the starter kit or through the official website of the PICASO 3D), User can use the Application on one or more pieces of Equipment.

After an activation of the Application PICASO 3D might provide you an Updates, Customer Support and Services.

Restrictions

Users are not allowed to commercial-based distribution of Application. In this case, “distribution” means any spread of an Application copy to the third-party, full or partially.

Users are not allowed to decompile, disassemble or modify the Application, full or partially.

Users are not allowed to delete a copyright mark, logo or any objects of intellectual properties of PICASO 3D from the Application.

You agree to use the Application only in compliance with its intended purpose and must not violate local laws.

Support

Customer support is free-based during the entire period of the Application usage in compliance with the PICASO 3D terms of support..

Customer support includes an advisory service about the Application usage. Customer support does not include an advisory service about integration of third-party products.

PICASO 3D must not provide customer support in case of changing a source or object code of the Application..

Use the Feedback option to ask a question. Further communication occurs by email or phone.

Customer service is able to use a customer data (email address).

Marketing

PICASO 3D would like to send you information about products and services of PICASO 3D that we think you might like. If you have agreed to receive marketing, you may always opt out at a later date.

Disclaimers; Limitations of Liability

PICASO 3D guarantee workability of the Application in compliance with its intended purpose by using a compatible version. Actual versions available on the official website of PICASO 3D.

You agree that the Application might use an auto-update system, which is able to download and install an Updates or Services.

You agree that the Application is not ideal and may contain errors. PICASO 3D recommend to keep it in mind..

PICASO 3D is not guarantee workability of the Application in case, if the User has violated the Terms of Use.

PICASO 3D is not guarantee workability of the Application in case, if the User does not apply an Updates.

You agree that Application provides built-in settings by default and you are responsible for any changes of Application configuration.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE POLYGON X ARE PROVIDED “AS IS”, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, QUALITY, NON-INFRINGEMENT OR MERCHANTABILITY. WE DO NOT WARRANT THAT YOUR USE OF THE POLYGON X ACCOUNT AND THE PICASO 3D SERVICES IS ERROR-FREE OR UNINTERRUPTED OR THAT WE WILL PRESERVE OR MAINTAIN YOUR DATA WITHOUT LOSS. NO ADVICE OR INFORMATION PROVIDED TO YOU BY PICASO 3D SHALL CREATE ANY WARRANTY. WE ALSO MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE SUITABILITY OR FITNESS OF THE POLYGON X ACCOUNT AND/OR THE PICASO 3D SERVICES FOR YOUR PURPOSES.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PICASO 3D OR ANY OF ITS AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, LOST DATA, FAILURE OF SECURITY MECHANISMS OR INTERRUPTION OF BUSINESS, INCURRED AS A RESULT OF YOUR USE OF THE PICASO 3D ACCOUNT AND/OR THE PICASO 3D SERVICES, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT OR OTHERWISE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE. THIS LIMITATION OF LIABILITY DOES NOT APPLY IN CASE THE DAMAGES ARE CAUSED BY WILFUL MISCONDUCT OR GROSS NEGLIGENCE OF PICASO 3D OR ITS MANAGERIAL STAFF.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF PICASO 3D OR ANY OF ITS AFFILIATES UNDER THESE TERMS OF USE THE AMOUNT YOU ACTUALLY PAID FOR THE APPLICATION, REGARDLESS WHETHER AN ACTION IS IN CONTRACT OR TORT OR OTHERWISE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE.

Intellectual property rights

All rights, title and interest in the Polygon X Account and/or the PICASO 3D Services, including but not limited to the available content and current and future applications are and will remain the exclusive property of PICASO 3D. The Polygon X Account and the PICASO 3D Services are protected by copyright and trademark laws. You are not allowed to use the trademark “PICASO 3D” or PICASO 3D distinctive features for any purpose.

You agree to not decompile, disassemble or modify the Application, full or partially, not delete any copyright and trademarks.

Open source products

The Application uses or might use an open source products which is licensed by GNU or any Open Source Licences. Users are able to use and modify these products in compliance with corresponding licenses. These cases have an advantage over other Terms of use clauses.

Changes and discontinuance

PICASO 3D may update and change the PICASO 3D Services from time to time. PICASO 3D may also at any time decide to discontinue the Services. Where commercially reasonably possible, PICASO 3D shall provide you with prior notice of such discontinuance, update, or change.

If User has got a notification of discontinuance, User is not allowed to use the Application anymore.
